1. Seller Account

• Registration:

  To become a seller, you must register for an account on the Website. You agree to provide accurate and complete information during the registration process.

• Account Security:

  You are responsible for maintaining the security of your account credentials and ensuring that unauthorized access does not occur.

• Authentication:

  We may require identity verification and business verification for certain sellers.

2. Mandatory Requirements

• For Grocery & Medical Sellers:

  All sellers selling food, grocery or medical supplies need to have an FSSAI licence, not having an FSSAI registration may lead to termination of seller account and legal actions may be taken.

• Electronics/Appliances Sellers:

  Sellers dealing in Electronics & Appliances must have a purchase invoice/brand approval or both, not having any legal proof may lead to account termination.

3. Product Listings

We use the collected information for various purposes, including:

• Accurate Information:

  You are responsible for the accuracy and completeness of your product listings, including descriptions, images, pricing, and inventory levels.

• Prohibited Items:

  You must not list prohibited items as defined in our Prohibited Items Policy.

• Intellectual Property:

  You affirm that you have the necessary rights to list and sell the products you offer. You must not infringe on third-party intellectual property rights.

4. Selling Process

We may share your information with third parties in the following circumstances:

• Orders:

  When a buyer places an order for your product, you are obligated to fulfill the order promptly and accurately.

• Communication:

  You are required to communicate with buyers professionally and respond to inquiries in a timely manner.

• Shipping:

  You agree to adhere to our shipping and delivery guidelines and provide accurate tracking information.

• Order Cancellation:

  Nivartha.com does not charge any penalty for order Cancellation from seller but, if any seller makes frequent or regular order Cancellations it may affect seller listing, rating or even termination of account.

5. Payments and Fees

• Payment Processing:

  Payments for orders will be processed through our payment gateway partners. You agree to pay applicable transaction fees and commissions as outlined in our Fees and Commissions Policy.

• Withdrawals:

  a. Withdrawal requests will be processed after seven + one (7 + 1) business days from the date of delivery of the order.
  b. Please note that the actual time it takes for funds to reach the seller's designated bank account or payment method may vary depending on the chosen withdrawal method and the financial institutions involved.

6. Customer Service

• Disputes:

  In case of disputes with buyers, you agree to work towards an amicable resolution following our Dispute Resolution Policy.

7. Intellectual Property

• License:
  By listing products on the Website, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute the content for promotional and marketing purposes.

• Sellers are responsible for ensuring that the products they list and the content they create comply with all applicable copyright laws and do not violate the intellectual property rights of others.

• Reporting Copyright Infringement:
  a. If a copyright owner believes that their intellectual property rights have been violated by a seller on Nivartha.com, they may submit a copyright infringement report to Nivartha.com's designated agent for copyright complaints. The report should include:

• i. A description of the copyrighted work that has been infringed.
  ii. Information identifying the infringing listing(s), including the product title, URL, and seller details.
  iii. Contact information for the copyright owner or their authorized representative.
  iv. A statement that the copyright owner has a good faith belief that the use of their copyrighted material is unauthorized.
  v. A statement made under penalty of perjury that the information provided is accurate and that the reporting party is the copyright owner or authorized to act on their behalf.

• b. Reports of copyright infringement should be sent to:

• Nivartha.com's Response to Copyright Infringement Reports:

• a. Upon receiving a valid copyright infringement report, Nivartha.com will promptly investigate the reported issue.

• b. If it is determined that copyright infringement has occurred, Nivartha.com may take various actions, including but not limited to:

• i. Removing or disabling access to the infringing content or listing.

• ii. Suspending or terminating the seller's account in accordance with our policies.

• iii. Providing the copyright owner with the necessary information to pursue legal action against the infringing party.

• Counter Notification:
  

  a. If a seller believes that their content or listing has been wrongly identified as infringing upon a copyright, they may submit a counter notification to Nivartha.com's designated agent. The counter notification should include:

• i. Identification of the material that has been removed or disabled and the location at which it appeared.

• ii. A statement under penalty of perjury that the seller has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.

• iii. The seller's contact information.

• iv. Consent to the jurisdiction of the federal court in the seller's location and an acknowledgment that the seller will accept service of process from the copyright owner or their agent.

• Repeated Infringement:
  

  a. Repeated copyright infringement by a seller may result in the suspension or termination of their account on nivartha.com, in accordance with our policies.

8. Termination

• Termination:

  We reserve the right to suspend or terminate your seller account if you violate these Terms, engage in fraudulent activities, or pose a risk to buyers or the platform's integrity.

9. Privacy

• Data Usage:

  We collect and use your personal information in accordance with our Privacy Policy.

10. Amendments

• Changes:

  We may update these Terms to reflect changes in our services or legal requirements. You will be notified of significant changes through the platform.
